Terms of Use

Short version: ZivBase is a private tool for P.D. Roth’s office. The public form lets you send information to the office. It is not a dating site, and nothing you send is shown to the public. Invited staff and shadchanim also agree to the Member Terms and Confidentiality Agreement, which adds stricter duties.

Who this is for

ZivBase has two parts. The office tool is invite-only: only people the office has invited may sign in, and they may use it only for the office’s work and within the permissions given. The public “Submit your information” form is open to parents, relatives and individuals who want the office to consider a person for introductions. ZivBase is operated by the office of P.D. Roth; it was designed by Stratified Signal and built by Unified Array.

What the form is, and is not

Reviewed by the office

A member of the office reads every submission. Nothing is added to the office’s records until the office accepts it. The office may decline a submission, or ask for more information, and does not have to give a reason.

No guarantee

The office works with care, but it cannot promise that an introduction will be suggested, that anyone will respond, that any introduction will lead to a match, or any response time. The information held may be incomplete, out of date or wrong, because it comes from many sources; nobody should rely on it without checking directly. Availability or marital status shown in the workspace is the office’s last known note, not a guarantee.

Your information

How we collect, use and keep what you send is explained in the Privacy Notice. By submitting the form you confirm that you have read it. You keep your rights in what you send; you give the office permission to store and use it privately for the purposes described there.

Availability and changes

We try to keep the site available and secure, but it is provided as it is and we cannot promise it will always work without interruption. We may change, suspend or stop parts of it.

Disclaimers

To the fullest extent the law allows, the site, the form and the office tool are provided “as is” and “as available”, without promises of any kind, express or implied, including fitness for a particular purpose, accuracy, completeness or uninterrupted operation. Nothing here is legal, religious, medical or other professional advice. Introductions are made in good faith and the people involved decide for themselves whether to proceed.

Limit of liability

To the fullest extent the law allows, the office, its staff, and the people who designed and built ZivBase are not liable for indirect, incidental, special, consequential or punitive losses, or for loss of opportunity, reputation or expected results, arising from the use of or inability to use the site or tool, or from any introduction or failure to make one. Where liability cannot be excluded, it is limited to [amount or cap to be set by the lawyer]. Nothing limits liability that the law does not allow to be limited, such as for fraud or intentional wrongdoing.

Responsibility for what you submit

You are responsible for the information you submit and for how you use the site. If you submit information you were not permitted to share, submit false information, or break these terms, and that causes the office or another person a loss or a claim, you agree to compensate them for the reasonable losses and costs that result, including reasonable legal fees, to the extent the law allows. Ending access

The office may remove a submission, suspend or end anyone’s access at any time if these terms are not followed or if the office decides it is needed to protect people’s information, and does not have to give a reason. You may stop using the site at any time and may ask the office to remove your information. The parts of these terms that by their nature should continue (confidentiality, responsibility, disclaimers, limits of liability and governing law) continue after access ends.

Governing law

These terms are governed by the laws of [jurisdiction to be chosen by the lawyer], and disputes are for the courts of [venue to be chosen by the lawyer].

Changes to these terms

We may update these terms. The version and effective date at the top show which one applies. When they change in a way that matters, invited members must accept the new version before they continue. Using the site after a change means you accept it.
